Limitation of Liability and Disclaimers

Zengenti Limited content, including the images, information, names, pictures, logos and icons regarding or relating to Zengenti Limited, its products and services (or to third party products and services), is provided "AS IS" and on an "IS AVAILABLE" basis without any representations or any kind of warranty made to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

Under no circumstances will Zengenti Limited be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of this site regardless of the form of action.

Zengenti Limited does not warrant that functions contained in content will be uninterrupted or error free, that defects will be corrected, or that Zengenti Limited or the server that makes it available are free of viruses or bugs.

Contributions to Insytful.com

Where you are invited to submit any contribution to Insytful.com (including any text, photographs, graphics, video or audio) you agree, by submitting your contribution, to grant Zengenti Limited a perpetual, royalty-free, non-exclusive, sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, make available to the public, and exercise all copyright and publicity rights with respect to your contribution and to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution, and in accordance with privacy restrictions set out in the Zengenti Limited Privacy Policy. If you do not want to grant Zengenti Limited the rights set out above, please do not submit your contribution.

You agree to use Zengenti Limited Community functionality (including message boards such as Slack) in accordance with the following Community Rules. These apply across all Zengenti Limited sites and services.

No unlawful or objectionable content: unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable.
Contributions must be civil and tasteful
If you use multiple logins for the purpose of disrupting the community or annoying other users you may have action taken against your accounts.
No disruptive, offensive or abusive behaviour: contributions must be constructive and polite, not mean-spirited or contributed with the intention of causing trouble.
Be patient: users of all ages and abilities may be taking part in the relevant Community.
No spamming or off-topic material: we don't allow the submission of the same or very similar contributions many times. Please don't re-submit your contribution to more than one discussion, or contribute off-topic material in subject-specific areas.
No advertising
No impersonation
No inappropriate (e.g. vulgar, offensive etc) user names
You may not refer to specific URLs (web site addresses) unless allowed specifically under the relevant service.

General

These terms shall be governed by and interpreted in accordance with the laws of England and Wales.

If there is any conflict between these terms and specific terms appearing elsewhere on the Zengenti Limited site then the latter shall prevail.

If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.

Services provided by us may only be used for lawful purposes. You agree to comply with all applicable laws, rules, and regulations in connection with your use of the services. Any material or conduct that in our judgment, violates this policy may result in suspension, termination of the services or removal of the user's account with or without notice.

The free tier is provided by Zengenti as-is. We retain the right to remove, suspend, and change the service at any moment with no notice. We are not responsible for any damages, data loss, or issues that might arise from you using Insyful.

We reserve the right to change our pricing and feature structure or level anytime.

Prohibited use

You may not use the services to scrape content or engage in activity that is illegal under applicable law, that is harmful to others, or that would subject us to liability, including, without limitation, in connection with any of the following, each of which is prohibited under this AUP:

Phishing or engaging in identity theft
Scraping web data for any purpose other than improving the quality of your web content. e.g. collecting personal information, phone numbers, email addresses and more for the purpose of cold calling, marketing, selling of data and more
Infringing the intellectual property or other proprietary rights of others

Fair usage

You may not exploit or bypass any of the limitations of your plan, such as scan frequency, scan limits, individual page scans, features and more.

There are currently no limitations on the number of individual page scans as long as it's part of a reasonable workflow to audit and improve your content. Using this feature in bad faith to scan or bypass account or pricing level restrictions is prohibited. e.g. using the individual page scan to scan more pages than part of your pricing level.

Creating multiple accounts to increase and exploit our free tier is prohibited. Having a separate personal and business account is fair and allowed. However, making multiple accounts for yourself or your business to gain more scan limits for free is prohibited.

Enforcement

Your services may be suspended or terminated with or without notice upon any violation of this policy. Any violations may result in the immediate suspension or termination of your account.

For any billing issues and missed payments, we might offer a grace period while you may continue using Insytful however, we do reserve the right to revoke access and suspend scanning.

Reporting violations
